If you are undertaking works on your property and there are potential issues that could arise that could affect a neighbouring property, JCT 6.5.1 insurance should be considered.

Although your contractors will have Public Liability insurance and Professional Indemnity insurance in place, if no negligence can be proved, you could be left with unnecessary risk attached during (or following) the work, which could leave you liable as the property owner.

For example, a reconstruction of a building has detailed drawings, with the work satisfactorily undertaken, but subsidence starts to occur after the completion that may have been caused by the work. As the owner of the property or the employer of the contractor, you could be liable.

JCT 6.5.1 insurance is usually put in place by the Contractor on behalf of their Employer and is placed in the joint names of the Contractor and the Employer. But, the insurance protects the employer against liability for loss, claims or proceedings that arise due to damage to adjacent property whilst undertaking a building contract that is deemed as ‘non-negligent’.

As the person or organisation employing the contractors, it is essential to ensure that you are not left liable through no fault of your own after any work has been completed.
